These following terms & Conditions will be applying on you when you will be using the application and site by any android/iPhone mobile phone and computer. This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

1. ELIGIBLITY:

To access and use our platform and its services, you must be at least eighteen (18) years old and competent to contract in terms of the Indian Contract Act, 1872. By accessing, using, browsing, or performing any other activity on the Platform, you hereby agree and represent that you are of a legal age and competent to enter into a contract under the Indian Contract Act, 1872 or you have the permission of your parent and/or guardian to do so.

2. REGISTRATION AND ACCOUNT:

You shall ensure that the Registration Data provided by You is accurate, complete, current, valid and true and is updated from time to time.

You may access the Platform and avail some Services using Social Media accounts, in which case these Terms along with terms of use and privacy policy of respective social media shall also be applicable to you. Further, we shall not be responsible for any kind of transmission, publication of any of your Information on any such social media.

You are solely responsible for maintaining the confidentiality of Your Registration

You must notify us immediately if you become aware of any unauthorised access or use of your Account.

In case, you are unable to access your account, please inform Us at [email protected] and make a written request for blocking your account.

ANIMALINE SERVICES

3. E-COMMERCE PLATFORM SERVICE:

3.1 Platform Overview:

Animaline is an online discovery platform to Buy/Sell trading animals (predominantly livestock) and animal related products or services, Users (“Users”, “you”, “your”) can:

• List Animals and Products: Sellers can list animals and related products for sale.

• Connect with Buyers: Facilitate connections between sellers and potential buyers.

• Purchase Products: Buy animals, animal food, medicines, and other related products.

• Interactive Features: Engage in discussions, exchange information, share multimedia content, and consult with veterinary professionals/experts online.

3.2 Sellers may list items under the following categories:

• Animals: Dogs, cats, cows, buffaloes, sheep, goats, hens, chickens, pigs, horses, rabbits, donkeys, birds, ducks, camels, butterflies, silkworms, honeybees, leeches, quails, mules, fish, turkeys, etc,.

• Products/Services: Fertilizers, animal feed, medicines, veterinary services, pet food shops, animal rescue services, veterinary hospitals, and veterinary doctors consultation.

3.3 Listing Guidelines:

When buyers come on the platform, they can see the listing based on their search criterion, they can either place the order or send an inquire/query to the seller.

When listing animals or products, Sellers must ensure:

• Legality: All animals listed are legal to keep in India.

• Non-Native Breeds: Only non-native breeds are allowed.

• Safety: Animals are non-poisonous and do not pose a threat to people or native wildlife.

• Accuracy: Descriptions, prices, and images must be accurate and truthful.

• Compliance: Listings must comply with all applicable laws and regulations.

Seller shall ensure the following guidelines – Seller shall not host, sell, display, upload, modify, publish, transmit, update or share any information which:

• Belongs to another person and to which You do not have any right to;

• Is grossly harmful, harassing, blasphemous, defamatory, obscene, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

• Is misleading in any way;

• Using the Site to drop ship merchandise to third parties;

• Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

• Infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity;

• Contains video, photographs, or images of another person (with a minor or an adult);

• Infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;

• Violates any law for the time being in force;

• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;

• Shall not be false, inaccurate or misleading; and harass, annoy, intimidate, or threaten any of our employees, agents, or other users;

• Users shall not share their personal, religious and/or moral views on the Site.

Sellers are expected to:

• Provide accurate and truthful information when listing products.

• Adhere to ethical and legal practices when buying or selling items, special care in the financial transactions.

• Take responsibility for transportation and delivery arrangements as agreed upon with the buyer.

• Abide by any applicable local, state, and national laws and regulations.

3.4 Accuracy of Information:

• Images and Descriptions: We strive to display product images and colours accurately. However, we cannot guarantee that your device’s display settings will render colours precisely

• Information Accuracy: While Animaline endeavours to ensure the accuracy of all information on the Platform, errors may occur. We reserve the right to correct any inaccuracies without liability.

3.4 Accuracy of Information:

• Images and Descriptions: We strive to display product images and colours accurately. However, we cannot guarantee that your device’s display settings will render colours precisely

• Information Accuracy: While Animaline endeavours to ensure the accuracy of all information on the Platform, errors may occur. We reserve the right to correct any inaccuracies without liability.

3.5 Price and Payment:

• Prices: Price/Offers/Discounts is based on the mutual agreement between Seller & Buyer. Users are not obligated to adhere to any specific pricing set by Animaline.

• Transactions: Animaline does not participate in the actual transaction between buyers and sellers, nor does it verify / participate in any matter to facilitate transactions between Buyers and Sellers.

• Once the price is agreed, our system will automatically drum up an invoice and send it to the buyer, who can then pay by card or net banking or deposit the cash in the Seller's account directly upon mutual agreement.

• Payment Process: Buyers can pay via credit/debit card, net banking, or direct deposit to the Seller’s account upon mutual agreement.

• Animaline does not come between seller and buyer for payment-related activities.

• Upon authorisation of your payment by clicking the “Order Now” button, you confirm the card belongs to you or that you are the legitimate holder of the card and have sufficient funds or credit facilities to cover the sale cost.

• The User is aware that in the case of third-party statements, the merchant name may appear in an abbreviated format, and Animaline has no control over this.

• Animaline is not liable for unauthorized transactions made through your account.

3.6 Transportation and Delivery:

• Once the buyer has paid, the goods/products/animals can be collected or delivered as agreed between the seller and the buyer. Sellers are responsible for arranging transportation and delivery of sold items.

• Users must enter the correct billing address, contact information, and shipping address (Street number and name, City, State, and Zip Code) as Animaline / Seller are not liable for packages sent to the wrong address.

• Shipping is solely the responsibility of the seller and user agreement; Animaline is not held responsible for any delivery of pets, products, or medicines.

• Animaline does not provide delivery services or assume responsibility for transportation or delivery. Delivery or shipping is the responsibility of the seller or buyer.

3.7 Communication:

Animaline is a platform for connecting buyers and sellers. All communication and transactions are the responsibility of the users. Animaline is not involved in actual transactions or quality of products.

3.8 Order Limitations:

• Limit Quantities: Restrict the quantity of products purchased by Users.

• Revise, Suspend, or Terminate: Modify, suspend, or terminate events or promotions without notice, including orders already submitted and acknowledged.

• Product Availability: We do not guarantee the availability of all listed products at the time of order placement or shipment.

3.9 Quality of Food Products or Medicines:

Any information provided on the platform regarding products, medicines, or services (e.g., product descriptions or instructions) is for informational purposes only and provided by the seller, not by Animaline. You should seek professional advice when appropriate and follow all product labels and instructions strictly.

3.10 Fees and Payments:

Animaline does not charge any fees to buyers or sellers for using the Platform.

4. DOCTORS / MEDICAL PRACTITIONER CONSULTATION SERVICE:

The Company is not a medical service provider and is not involved in providing healthcare services or medical advice. It is a digital platform that facilitates connections between medical professionals and Users through the Site. The Site provides options for booking consultations, but online services are not a substitute for traditional veterinary care, and users assume full risk of limitations.

4.1 Cancellation:

• If a product is listed at an incorrect price or with incorrect information due to an error, we reserve the right to cancel affected orders.

• Customers can cancel orders within 24 hours, provided the item has not yet been shipped. Once delivered, an order cannot be canceled.

• Animaline does not provide refunds for buy or sell orders.

4.2 Fees and Payments:

Animaline does not charge any fees for consultation services.

5. ADVERTISING AND ADMOB

5.1 Types of Advertisement

Animaline offers two primary methods for Users to advertise and promote their listings:

• Third-Party Advertising via Networks like Google AdMob
  Animaline can display ads on the Animaline platform through external advertising networks such as Google AdMob. This follows the advertising policies of these third-party networks.

• Internal Listing Boost/Promotion
  Users can boost or promote their listings directly on the platform to maximize reach and visibility among other Animaline users.

5.2 Internal Listing Boost/Promotion Guidelines

Users can opt to boost or promote their listings on Animaline to increase their visibility within the platform. Animaline offers various tiers of promotional options based on the duration and level of exposure.

5.3 Payment and Fees

• Pricing Structure: Fees for boosting or promoting listings will be displayed at the time of purchase. These fees are subject to change at Animaline's discretion, and the most current pricing will always be available on the platform.

• Payment Methods: Users can pay via credit card, debit card, net banking, or any other payment method supported by Animaline at the time of purchase.

• Non-Refundable: Fees for boosting or promoting listings are non-refundable, except where otherwise stated by Animaline or required by applicable law. If your advertisement is removed or your account is terminated due to a violation of these Terms, no refunds will be provided for any unused portion of your advertising or promotion fees.

5.4 Duration of Boost/Promotion

• Limited Time Visibility: The promotion or boosted status of a listing is valid only for the duration specified at the time of purchase. Once the promotion period ends, the listing will return to its normal ranking on the platform.

• No Guarantee of Sales: Boosting or promoting a listing does not guarantee that the item will sell or receive inquiries. It only increases visibility within the platform.

5.5 Content Approval for Promoted Listings

• Promoted listings are subject to the same content guidelines as general listings. Animaline reserves the right to reject or remove any listing that violates platform policies, even if it has been promoted.

• Animaline reserves the right to reject or remove any advertisement at its discretion, particularly those that violate these guidelines or harm the reputation of the platform.

6. THIRD-PARTY LINKS INSIDE/OUTSIDE OF THE PLATFORM

• Certain content, products, and services available via our Service may include materials from third-parties.

• Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

• We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with third-party websites. Please review third-party policies and practices carefully before engaging in any transaction.

7. USE OF GOOGLE MAPS

You agree and acknowledge that mapping services on the Animaline Application are provided through the Google Maps API by Google Inc. By downloading, installing, or using the Animaline Application, you agree to be bound by the Google Terms of Use. It is your responsibility to review, determine applicability, and comply with the Google Terms of Service. Animaline will not be responsible for any liability or loss/damage caused by reliance on Google Maps services.

8. DISCLAIMER

You may not access or use the Site for any purpose other than that for which we make the Site and our services available. The Site may not be used in connection with commercial endeavors except those specifically endorsed or approved by us.

Our Site is directed to people residing in India. The information provided is not intended for distribution to or use by anyone in jurisdictions where it would be contrary to law or regulation.

In no event, including negligence, shall Animaline or any of its affiliates be liable for damages arising from use of the Site or content, user information provision, or loss of business, even if advised of such damages. Animaline also disclaims responsibility for the quality of animals or organisms listed, supporting no animal cruelty or activities prohibited under the Prevention of Cruelty to Animals Act, 1960, and Wildlife Protection Act 1972. Users committing such offenses are solely liable.

9. NO WARRANTY

Animaline makes no warranties, express or implied, regarding the Platform's availability, accuracy, or fitness for a particular purpose. We accept no liability for any loss, cost, or inconvenience related to the health, fitness, quality, or resemblance of organisms or items listed on the platform.

10. DISPUTE RESOLUTION

Users are encouraged to resolve any disputes or issues related to transactions directly with the other party involved. The Organization is not responsible for dispute resolution.

11. LIABILITY

The Organization is not liable for any issues arising from transactions, including but not limited to product quality, delivery delays, or disputes between users.

12. LINKS TO OTHER SERVICES

Animaline may provide links, in its sole discretion, to other services. Animaline is not responsible for the availability of these outside resources or their contents. Animaline expressly disclaims any responsibility for the content, materials, accuracy of information, and/or the quality of the products or services provided by, available through, or advertised on these third-party services, or the products or services provided by any third party.

13. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

14. “AS IS” AND “AS AVAILABLE” DISCLAIMER

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Animaline, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Animaline provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected.

15. FORCE MAJEURE

15.1 Definition of Force Majeure

Animaline shall not be liable for any failure or delay in performing its obligations under these terms and conditions when such failure or delay is directly or indirectly caused by circumstances beyond its reasonable control, including but not limited to acts of God, fires, floods, earthquakes, epidemics, pandemics, strikes, labor disputes, government actions, war, terrorism, or any other events or conditions beyond the control of the Organization.

15.2 Impact of Force Majeure

In the event of a Force Majeure event, Animaline shall be excused from performance for the duration of the event and shall not be held responsible for any resulting damages, losses, or liabilities incurred by users or third parties.

15.3 Communication and Mitigation

Animaline shall make reasonable efforts to inform users affected by a Force Majeure event and take appropriate steps to mitigate its impact. However, Animaline does not guarantee the ability to fully resume normal operations during or after such an event.

15.4 Termination Due to Prolonged Force Majeure

If a Force Majeure event continues for an extended period and substantially prevents Animaline from performing its obligations, either party may choose to terminate the affected portion of these terms and conditions without incurring any liability.

15.5 User Precautions

Users are encouraged to take appropriate precautions and make contingency plans to account for the possibility of a Force Majeure event affecting their use of the platform.

16. SUSPENSION OF USER ACCESS AND ACTIVITY

Notwithstanding other legal remedies that may be available to it, Animaline may in its sole discretion limit the User's access and/or activity by immediately removing the User's access credentials either temporarily or indefinitely, or suspend/terminate the User's membership, and/or refuse to provide User with access to the platform, without being required to provide the User with notice or cause:

1. If the User is in breach of any of these Terms or the Policy;

2. If the User has provided wrong, inaccurate, incomplete, or incorrect information;

3. If the User's actions may cause any harm, damage, or loss to the other users or to the Website, at the sole discretion of Animaline.

17. LIMITATION OF LIABILITY

Under no circumstances shall Animaline or its affiliates, partners, suppliers, or licensors be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of, or inability to access or use, the application and any third-party content and services. Whether or not the damages were foreseeable and whether or not Animaline was advised of the possibility of such damages, without limiting the generality of the foregoing, Animaline's aggregate liability to you (whether under contract, tort, statute, or otherwise) shall not exceed the amount of five hundred rupees (Rs. 500/-). The foregoing limitations will apply even if the above-stated remedy fails of its essential purpose.

18. INDEMNITY

You agree to indemnify and hold Animaline and its officers, directors, employees, and volunteers harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (a) your use of Services; (b) your breach of Terms of Use; and (c) your violation of any third-party rights.

19. SEVERABILITY

If any of the provisions, or portions thereof, of these Terms of Use are found to be invalid under any applicable statute or rule of law, then, that provision notwithstanding, these Terms of Use shall remain in full force and effect, and such provision or portion thereof shall be deemed omitted.

20. WAIVER

Any waiver of any provision of these Terms of Use, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right.

21. COMMUNICATIONS

You agree and acknowledge that Animaline may communicate with you by e-mail, SMS, push notifications, telephone, or by posting notices on the Animaline Website/Application or through any other mode of communication. You agree that all terms/agreements, notices, disclosures, and other communications that Animaline provides to you will electronically satisfy any legal requirement that such communications be in writing.

For contractual purposes, you agree and consent to receive communications from us (as set out in this Section) with respect to the Animaline Website/Application including information regarding your account or updates/changes to the Animaline Application, and/or any functionalities/features available on the Animaline Application or any information which Animaline or a Transportation Provider authorized by Animaline as per the Privacy Policy communicates to you from time to time (including lifestyle, disease, or health-related notifications).

22. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Use and any contractual obligation between the Parties will be governed by the laws of Other Party(s) access to, or use of, the CHANNEL or these Terms of Use shall be subject to the exclusive jurisdiction of the courts at Karnataka. All disputes will be subject to arbitration at Karnataka in English by a sole arbitrator appointed by Intern Infotech Private Limited under the Arbitration and Conciliation Act, 1996.

23. ACKNOWLEDGMENT

The Terms listed in this document apply to all individuals who access and use Our App/Website. These Terms govern the relationship between Animaline and its users. They explain all rules and regulations the users of Animaline need to follow.

By continuing to use Our Website/App, We assume you accept all Terms that are listed in this document as well as accept and comply with the Privacy Policy of the Company. Our Privacy Policy describes how We use, collect, and share Your personal information when You access the Website and explains Your rights and how the law protects You.

24. ACCEPTANCE OF TERMS AND MODIFICATION THEREOF

• The Terms constitute an agreement between the User and Animaline, with regard to the access and use of the Platform for the following categories of services.

• Animaline reserves the right, in its sole discretion, to terminate the access of the Visitor to the App or any portion thereof at any time, without any prior notice.

• The Terms shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine.
